Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of DigitalMarketersForum.com, including its forums, marketplace, paid areas, advertising services, messaging features, and other associated services (collectively, the “Service”).

By accessing, registering for, purchasing through, or otherwise using the Service, you agree to these Terms and to any policies incorporated into them, including our Privacy Policy, Marketplace Rules, and Community Rules. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to create an account, purchase a paid service, advertise, or participate in the marketplace.

By using the Service, you represent that:

  • You have the legal capacity to enter into these Terms;

  • The information you provide is accurate and current;

  • You are not prohibited by applicable law from using the Service; and

  • If you use the Service for a business or organization, you have authority to bind that entity to these Terms.

2. Accounts and Account Security

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account.

You must not:

  • Create an account using false or misleading information;

  • Impersonate another person, business, or organization;

  • Share, sell, transfer, or permit another person to use your DMF account without our written permission;

  • Create multiple accounts to evade restrictions, manipulate reputation, inflate engagement, or mislead other users; or

  • Access another user’s account without authorization.

Notify us promptly at iour Contact Us page if you believe your account has been compromised. We are not responsible for losses caused by your failure to protect your credentials.

3. Nature of the Service

DMF provides a platform where users can discuss digital marketing, publish content, communicate, advertise, and offer or purchase goods and services.

Unless we expressly state otherwise:

  • User content represents the views of its author, not DMF;

  • We do not create, endorse, verify, or guarantee user content;

  • We do not guarantee the identity, qualifications, honesty, legality, or performance of any user;

  • We are not a party to transactions between users;

  • We do not hold funds in escrow; and

  • We are not an agent, employer, partner, broker, fiduciary, mediator, or representative of any user.

You are responsible for conducting appropriate due diligence before relying on information or entering into a transaction.

4. User Content

“User Content” means material submitted, posted, uploaded, transmitted, or otherwise made available through the Service, including posts, messages, reviews, listings, images, files, links, and profile information.

You retain ownership of your User Content. By submitting User Content, you grant DMF a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, format, display, distribute, and otherwise use that content as reasonably necessary to operate, promote, secure, and improve the Service.

This license continues for as long as the content remains on the Service and for a reasonable period afterward in backups, archives, quotations, and records required for legal, security, or operational purposes.

You represent that:

  • You own or have permission to use your User Content;

  • Your User Content does not infringe another party’s rights;

  • Your User Content is accurate where presented as factual; and

  • Posting it does not violate any law, contract, confidentiality obligation, or these Terms.

We may, but are not required to, review, reject, edit, restrict, move, or remove User Content. Publication does not mean that DMF has reviewed or approved it.

5. Prohibited Content and Conduct

You must not use the Service to engage in, facilitate, solicit, advertise, instruct others in, or distribute material involving:

  1. Fraud, theft, identity theft, phishing, carding, money laundering, deceptive billing, fake reviews, forged documents, or misrepresentation;

  2. Unauthorized access to computers, accounts, networks, devices, databases, or services;

  3. Malware, ransomware, spyware, botnets, credential-stealing tools, destructive code, or unauthorized exploits;

  4. Stolen, hacked, fabricated, or unlawfully obtained data, identities, payment information, accounts, credentials, cookies, tokens, or access methods;

  5. The sale, transfer, rental, or purchase of third-party accounts when prohibited by law, the provider’s rules, or the account owner, including payment processor, advertising, social media, financial, marketplace, or verified accounts;

  6. Spam, unsolicited bulk messaging, cookie stuffing, fraudulent clicks, deceptive lead generation, traffic manipulation, or artificial engagement;

  7. Counterfeit goods, illegal drugs, weapons, unlawful financial schemes, or other prohibited or regulated products;

  8. Copyright infringement, trademark infringement, piracy, unauthorized software distribution, or circumvention of technological protections;

  9. Harassment, threats, stalking, doxxing, exploitation, hate speech, or content encouraging violence or discrimination;

  10. Sexual exploitation, non-consensual intimate material, or any sexual content involving minors;

  11. False earnings claims, fabricated testimonials, undisclosed paid endorsements, or misleading marketing claims;

  12. Attempts to manipulate rankings, reviews, reputation scores, reactions, referrals, post counts, or other Service features;

  13. Scraping, crawling, harvesting, or automated collection of information without written permission;

  14. Circumventing bans, access restrictions, fees, moderation controls, or technical safeguards;

  15. Excessive self-promotion, unauthorized solicitation, or advertising outside designated areas;

  16. Uploading files or links that create a security, privacy, or operational risk; or

  17. Any activity that violates applicable law or encourages another person to do so.

Examples are illustrative and not exhaustive. We may restrict conduct that threatens users, the Service, third parties, or DMF’s reputation or operations.

6. Marketplace Transactions

The marketplace allows independent users to advertise, buy, or sell permitted goods and services. DMF does not guarantee listings, results, delivery, quality, legality, or payment.

Marketplace users must:

  • Describe their offer truthfully and disclose material limitations;

  • Possess all rights, licenses, approvals, and permissions required to provide it;

  • State prices, deliverables, timelines, renewal terms, and refund conditions clearly;

  • Comply with consumer-protection, advertising, tax, privacy, intellectual-property, and other applicable laws;

  • Avoid fake scarcity, fabricated testimonials, misleading metrics, and guaranteed-result claims without a reasonable substantiated basis;

  • Protect customer information and use it only for the agreed transaction; and

  • Maintain sufficient records to substantiate claims and resolve disputes.

Transactions are solely between buyer and seller. Each party is responsible for evaluating the other party, establishing written terms, selecting a payment method, keeping records, and obtaining professional advice where appropriate.

DMF is not required to mediate a dispute, recover funds, compel delivery, or compensate either party. We may nevertheless investigate complaints and restrict accounts or listings at our discretion.

7. Reviews, Feedback, and Reputation

Reviews and reputation indicators reflect users’ opinions and are not endorsements or guarantees by DMF.

Reviews must relate to genuine interactions or transactions. Users must not post or arrange fake, retaliatory, coercive, purchased, or misleading reviews. We may remove or modify feedback where we reasonably believe it is fraudulent, abusive, irrelevant, unlawful, or inconsistent with our rules.

8. Affiliate Links, Promotions, and Advertising

Affiliate links, advertisements, sponsored content, commercial signatures, contests, promotions, and solicitations may be posted only in areas and formats authorized by DMF.

Users must clearly disclose affiliate, sponsorship, or other material relationships and comply with applicable advertising laws and platform rules.

We may reject, remove, suspend, or require changes to advertising that is misleading, unlawful, technically harmful, inappropriate, or inconsistent with our policies. Purchasing advertising does not constitute endorsement by DMF.

9. Paid Memberships and Fees

Certain features may require payment. Prices, billing periods, benefits, and applicable taxes will be disclosed at the point of purchase.

By purchasing a subscription, you authorize us and our payment processor to charge the applicable fees using your selected payment method. If a subscription automatically renews, that fact and the renewal interval will be disclosed before purchase. 

Except where applicable law requires otherwise or a specific offer states differently:

  • Fees are charged in advance;

  • Fees are non-refundable once access or advertising has been provided;

  • Cancellation prevents future renewals but does not retroactively refund the current billing period;

  • Removing content or terminating an account for a violation does not entitle the user to a refund; and

  • Users are responsible for applicable taxes and payment-processing charges disclosed at checkout.

If a payment is reversed, disputed, overdue, or unsuccessful, we may suspend the associated service or account while the matter is resolved.

10. Intellectual Property

The Service and its original software, design, branding, logos, databases, organization, and content supplied by DMF are owned by or licensed to DMF and are protected by applicable intellectual-property laws.

These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. They do not grant you ownership of DMF’s intellectual property.

You may not copy, republish, sell, reverse engineer, frame, mirror, or commercially exploit the Service or DMF content without written permission, except where applicable law expressly permits it.

11. Copyright and Intellectual-Property Complaints

If you believe material on the Service infringes your rights, send a notice to our Contact Us page containing:

  • Your name and contact information;

  • Identification of the protected work or right;

  • The URL or sufficient information to locate the allegedly infringing material;

  • An explanation of why you believe the use is unauthorized;

  • A statement that the information supplied is accurate and submitted in good faith;

  • A statement that you own the relevant right or are authorized to act for its owner; and

  • Your physical or electronic signature.

We may remove or restrict disputed material and may terminate repeat infringers where appropriate. We may forward the complaint to the user who posted the material.

12. Moderation, Suspension, and Termination

We may investigate activity and issue warnings, remove content, restrict features, suspend accounts, or terminate access when we reasonably believe it is necessary to:

  • Enforce these Terms or other forum rules;

  • Protect users, DMF, or third parties;

  • Prevent fraud, abuse, legal exposure, or security threats;

  • Respond to a legal requirement; or

  • Preserve the integrity and operation of the Service.

Serious violations may result in immediate termination without prior notice. We are not required to apply warnings progressively or identically in every case.

You may stop using the Service at any time. You may request account closure by leaving us a message on our Contact Us page. Some content and records may be retained where reasonably necessary for legal compliance, fraud prevention, dispute resolution, backups, or legitimate operational purposes.

13. Third-Party Services and Links

The Service may contain links, integrations, advertisements, or content relating to third-party websites, products, or services. DMF does not control or endorse those third parties and is not responsible for their availability, security, accuracy, terms, privacy practices, or performance.

Your dealings with a third party are between you and that third party. Review its terms and policies before using its services or providing information.

14. Educational Information; No Professional Advice

Forum content is provided for general informational and educational purposes. It is not legal, financial, tax, investment, medical, cybersecurity, or other professional advice.

Marketing methods and business results vary. DMF does not promise income, traffic, rankings, conversions, platform approval, or any other result. You are responsible for evaluating information and complying with the rules of advertising networks, search engines, payment providers, social platforms, and other services you use.

15. Privacy

Our collection and use of personal information are described in our Privacy Policy, which is incorporated into these Terms.

We may preserve or disclose information when reasonably necessary to comply with law, respond to legal process, enforce these Terms, investigate fraud or security incidents, or protect the rights and safety of users, DMF, and others.

16. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.”

DMF disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and uninterrupted operation.

We do not warrant that:

  • The Service will always be available, secure, or error-free;

  • User content or marketplace listings are accurate or lawful;

  • Files, links, or third-party services are free from harmful components;

  • A user will complete a transaction or satisfy an obligation; or

  • Use of information obtained through the Service will produce any particular outcome.

Nothing in these Terms excludes a warranty or right that applicable law does not permit us to exclude.

17. Limitation of Liability

To the maximum extent permitted by law, DMF and its owners, officers, employees, contractors, moderators, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, opportunities, or business interruption arising from the Service.

To the maximum extent permitted by law, DMF’s total liability for all claims arising from or relating to the Service will not exceed the greater of:

  1. The amount you paid directly to DMF during the six months preceding the event giving rise to the claim; or

  2. US$100.

These limitations do not apply where liability cannot lawfully be limited, including any liability that applicable law prohibits us from excluding.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless DMF and its owners, officers, employees, contractors, moderators, affiliates, and service providers from claims, damages, losses, liabilities, penalties, and reasonable legal expenses arising from:

  • Your User Content;

  • Your use or misuse of the Service;

  • Your marketplace transactions;

  • Your violation of these Terms or applicable law; or

  • Your infringement of another party’s rights.

We may assume control of the defense of a matter covered by this section, and you agree to provide reasonable cooperation.

19. Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service.

We may also update these Terms. When changes are material, we will provide reasonable notice through the Service, by email, or by another appropriate method. The updated Terms will state their effective date.

Your continued use after the effective date constitutes acceptance of the updated Terms. Changes will not apply retroactively where prohibited by law.

20. General Provisions

If part of these Terms is held invalid or unenforceable, the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, restructuring, or transfer of the Service.

These Terms and the policies incorporated into them constitute the entire agreement between you and DMF concerning the Service.

Sections that by their nature should survive termination, including intellectual-property provisions, disclaimers, liability limitations, indemnification, and dispute provisions, will survive.
